Egyptian ethical complaint

Posted here, as mailed in Jan 2015 to the head of the FIDE Ethics Commission. The evidence contains:

• A letter [Oct 2014] from Kirsan to the Egyptian Minister of Youth & Sports regarding Elgendy's (the ECF President, and a member of the FIDE Executive Board) actions and reimbursement for the period Apr 7 to Apr 30 in 2014. It "confirms" that Elgendy "has attended the meetings of the extraordinary FIDE EB meeting... from 7th to 30th of April" and "was asked to help in some Technical issues but was not paid for this additional volunteered work."
• • An email [Mar 2014] from Freeman to the ECF that invites Elgendy to "attend FIDE EB meetings to be held ... from 7th April to 30 April", and states FIDE will cover any expenses.
  • An email [Oct 2014] from an ECF board member (Wael Elazaly) to FIDE asking about this EB meeting, and the FIDE reply (regarding confusing the dates of the meeting with the dates of the attendant tournament).
  • A letter [Nov 2014] from Borg (CEO of FIDE) to Elgendy saying that Kirsan will personally give $10000 to the ECF for their development project.
  • A page showing that said money was indeed transferred
• • A highlighted passage from the CoE: offers, or attempts to offer or accepts any consideration or bribe with a view of influencing the result in a game of chess or election into FIDE office.
  • A recitation of 2.2.11 of the CoE: Any conduct likely to injure or discredit the reputation of FIDE, its events, organizers, participants, sponsors or that will enhance the goodwill which attaches to the same.
  • Statute 5.3: The Executive Board meets as a rule immediately before the General Assembly and once per non Olympiad (however, it can be convened by the President at any time).
  • Statute 4.2: The decisions of the General Assembly will be published on the FIDE web site within two weeks of the close of the meeting. The final minutes shall be published no later than eight weeks after the meeting is closed. The Secretariat shall publish any amendments to the FIDE Statutes and regulations on the FIDE website within three weeks of the close of the General Assembly meeting at which they were adopted. A separate document showing the amendments in track changes shall be included. [Statute 5.4 says that EB meetings/minutes are subject to the same procedures as the GA].
  • The final resolution of disputes part of the Statutes are copied, with nothing particular being highlighted.
• "How to volunteer without pay": pictures of Elgandy (sic) "volunteering as head of the Appeals Committee without pay" in the FIDE Women World Rapid & Blitz Championship 2014.
• "Does not exist for the historic meeting of the Executive Office of the International Federation of Chess for 24 Days": not sure what this is showing, it gives the dates of the Womens' Candidates Tournament as Mar 11 to Apr 1, the Grand Prix from Apr 7 to Apr 22, and the Rapid & Blitz Championship from Apr 21 to Apr 29. As indicated in the email to Wael Elazaly, there is some confusions over the dates of the actual EB meeting. The webpage photo (indeed, accessible as the FIDE secretary said, by clicking on Calendar) says: Presidential Board / Congress: 1st Quarter 2014 Presidential Boar Khanty-Mansiysk, Russia 29-Mar-2014 to 1-Apr-2014... note that these days do not intersect Elgendy's itinerary, and in any case that would be the PB, not the EB. It does not seem that EB meetings are listed in the Calendar (unlike what the FIDE secretary suggested).
• "Regulations for the FIDE Women World Blitz Championship 2014 FIDE Women World Rapid Championship 2014", where I see nothing highlighted. Relevant are: 6.19 regarding the Chairman of the Appeals Committee writing a report at the end of the event; and 8.1a indicating that a "FIDE representative" will be said Chairman, and is appointed by the FIDE President (after consulting with the organising committee); 11.7 which lists $3500 as the fee for the Chairman.
• Report of the arbiter regarding said events. In #3, Elgendy is listed as the Chairman of the Appeals Committee, and is also thanked in #12.

I have no idea what the actual complaint it. My guess is that the ECF board is complaining that the $10000 was in fact an under-the-table payment for Elgendy being the head of the Appeals Committee? And that the Executive Board did not really meet during the 24-day period [which could be just as much a complaint against Freeman/Kirsan as anyone else]? Note that the FIDE Minutes page does list anything for an EB meeting in that period.

The Statutes regarding the EB read: the Executive Board can be convened by the FIDE President at any time, and that the Agenda of the meetings of the Executive Board and the minutes are subject to the same procedures as the General Assembly.

BB+ quoted from public sources, so there was nothing to "keep" private here. And posting on OpenChess is not the same as publishing a press release, for example.

As far as I can tell there might be no Egyptian scandal at all, but if there are public accusations why not try to get the whole picture. We'll see what comes out of it.
